The family of Giovanni Mendoza Martinez is suing Tesla, claiming misleading advertising and statements by Elon Musk led Mendoza to believe his Tesla Model S could safely operate autonomously. Mendoza, 31, was killed in a high-speed crash in February 2023 while his car's Autopilot was engaged, and his brother Caleb was severely injured. The lawsuit argues that Tesla’s Autopilot system is defective, particularly in recognizing emergency vehicles, and accuses the company of knowingly overstating the technology's capabilities.
Brett Schreiber, representing the Mendoza family, criticized Tesla’s practices, stating, “This is yet another example of Tesla using our public roadways to perform research and development of its autonomous driving technology. The injuries suffered...were entirely preventable.”
