Bass Pro Shops Class Action Lawsuit: False Advertising Lawsuit Filed Over RedHead Socks Lifetime Guarantee

Singleton Schreiber has filed a $5 million class action lawsuit against Bass Pro Shops for falsely advertising a “lifetime guarantee” on their RedHead brand all-purpose wool socks.

The company advertised the sock guarantee, saying “If ever they wear out, just return them for a FREE replacement!” But after years of honoring the offer, the company recently began offering customers another type of sock as a replacement instead — one that only came with a 60-day guarantee.

Plaintiff Kent Slaughter has filed a false advertisement lawsuit against Bass Pro Shops in Springfield, Missouri federal court, claiming they defrauded him by rescinding their offer of a lifetime guarantee on RedHead all-purpose wool socks.

Slaughter said he had a dozen pairs of the socks that he would regularly bring in to have replaced once they became worn out. He did this for years as the company honored their offer, but said that the company changed the guarantee in 2021.

Singleton Schreiber’s Class Action Lawsuit Against Bass Pro Shops

Singleton Schreiber’s suit against Bass Pro Shops is open to any “other similarly-situated consumers who purchased from Defendant Bass Pro ‘Redhead Lifetime Guarantee All- Purpose Wool Socks,’ in order to obtain damages, restitution, injunctive, and other relief necessitated by Defendant’s unlawful, unfair, and fraudulent advertisement concerning its Redhead Lifetime Guarantee All- Purpose Wool Socks (the ‘Socks’ or the ‘Product’).”

The lawsuit states:

Defendant Bass Pro has uniformly misrepresented to consumers, and continues to misrepresent to consumers, that its Product is sold with a “Lifetime guarantee” warranty (the “Lifetime Warranty”), meaning that a purchaser can return the Socks when they wear down and Defendant Bass Pro will always replace them with a new pair of Socks.  Among other advertisements and representations, Defendant offers the Socks for sale, along with the following promise: “Lifetime guarantee – if they wear out, they get replaced!”

The class action case is seeking $5 million is damages and showing that any business engaging in false advertisement can be held accountable, no matter the claim, product, or offer. 

“Bass Pro Shop made a promise to its customers when it offered its RedHead socks with a lifetime guarantee,” Singleton Schreiber lawyers Andrew Bluth and Chris Rodriguez said. “Those words should mean something.”
